Term Charter Cancellation Policy

These terms and conditions govern the Tampa Luxury Charters Term Charter Cancellation Policy (the “Term Charter Cancellation Policy” or “Multi-day Charter Cancellation Policy”) available to Charterers and Owners through the Services offered by Tampa Luxury Charters. Tampa Luxury Charters enforces a standardized Term Charter Cancellation Policy for all boats on the platform offering charters of more than 12 hours to protect both Renters (“Charterers” or “Guests”) and Boat Owners (“Owners”). Each party may cancel at any time. The applicable fee schedule depends on when the cancellation occurs relative to the reservation’s set sail, departure, or check-in date.

Please note any weather-related cancellations (e.g., named storms, thunderstorms, high winds) are at the sole discretion of the Captain or Owner. Weather conditions are assessed on the day of departure, not by prior forecasts.

Cancellation Policy:

  • The 5% booking fee is non-refundable immediately after payment, regardless of the departure date or cancellation timing.
  • Cancellations made 60 or more days before departure receive a 50% refund of booking charges; the 5% booking fee remains non-refundable.
  • Cancellations within 59 days of departure are non-refundable; the 5% booking fee is also non-refundable.

All cancellations must be made in writing by emailing Charters@TampaLuxuryCharters.com.

COVID-19 Policy:

From May 31, 2022, COVID-19 related cancellations are no longer covered under this policy. Reservations made before this date with a positive PCR test within 5 days of departure may qualify for consideration.

Provision Orders:

Provisioning services (food and beverage) are available after reservation and account verification. Provision orders must be submitted at least 7 days prior to departure. Provision orders are non-refundable if the charter is canceled. Customers are responsible for picking up provisions from the vessel pickup location. Partial or full refunds may be provided only in rare cases where provisions have not been ordered, cooked, or prepared.

Rescheduling Fees:

A rescheduling fee equal to the 5% booking fee will be applied for changes requested by the customer. This fee may be waived if caused by mechanical failure, weather (determined by the Captain), Captain no-show, or lack of access to the vessel, subject to evaluation by Tampa Luxury Charters’ Customer Service Team.

Extenuating Circumstances:

Tampa Luxury Charters will consider exceptions with supporting documentation. In such cases, the Charterer may receive a partial or full voucher or refund and the Owner may forfeit payment. Examples include:

  • Proximity (within 100 miles) to named storms within 24 hours of departure.
  • Government-declared public health emergencies or epidemics (excluding endemic diseases and COVID-19).
  • Mandatory government travel restrictions such as evacuation orders.
  • Acts of war, terrorism, hostilities, and large-scale utility outages.
  • Natural disasters that prevent completion of the reservation (e.g., mandatory evacuations).
  • Mechanical failures causing inoperability, reported during the trip and unresolved after opportunity to fix.
  • Owner or Captain cancellations, no-show, or no access to the boat.
  • Problems causing premature termination of rental due to negligence of Owner or Base Operator.
  • Material inaccuracies in boat listing details or availability.
  • Cancellations by Tampa Luxury Charters to protect customer safety or prevent fraud.

Events not covered by this policy remain subject to the Owner’s Term Charter Cancellation Policy. Non-covered examples include personal illness, legal obligations, non-binding advisories, unrelated transportation disruptions, and event cancellations not directly tied to the reservation location.

Owner Responsibilities and Penalties:

Owners are responsible for maintaining minimum quality standards and must be available or provide a third party to assist renters within 24 hours after check-in. Tampa Luxury Charters reserves the right to penalize Owners who cancel reservations or fail quality standards by:

  • Blocking dates of canceled bookings.
  • Charging fees equal to Owner’s net rental income for multiple cancellations in 6 months.
  • Lowering boat listing rankings.
  • Posting reviews noting cancellations.
  • Charging cleaning, refueling, cancellation, and booking fees as appropriate.

General Provisions:

  • This policy is not insurance and does not replace any insurance policies held by Renters.
  • Benefits are non-transferable and non-assignable.
  • Tampa Luxury Charters may modify or terminate this policy without prior notice and will notify users of changes via the platform.
  • This policy applies only to charters longer than 12 hours.

Governing Law:

This Term Charter Cancellation Policy is governed by the laws of the State of Florida.

Limitation of Liability:

Tampa Luxury Charters’ aggregate liability under this policy is limited to the amount of boat fees collected from the Renter. Some jurisdictions may not allow limitation of liability for incidental or consequential damages.
